WHAT INFORMATION IS COLLECTED THROUGH THE SERVICES?

HOW CAN I ACCESS, CORRECT, AMEND OR DELETE MY PERSONAL INFORMATION AND/OR OPT OUT OF FUTURE COMMUNICATIONS?
Except as required by law, you have a right to choose 1) whether we share your User information with a third party, 2) use your User information in a way you didn’t originally permit, or 3) keep your User information. You may contact us to ask about your User Information we have, and to correct, amend, or delete such information. We reserve the right to limit the number of times such a request can be made and to charge you for responding to such requests if this process is misused or abused. Please be aware that opting out of certain third-party use may prevent us from providing the services or products that you request.
User agrees to use the Services solely for lawful purposes. User will not use the Services to disseminate or transmit materials that a reasonable person would consider abusive, obscene, defamatory, harassing, threatening, or malicious. The Services and its contents are intended for exclusive access within the United States. Access to the Services from locations where the Services or its content is illegal is prohibited. If you access the Services from a location outside of the United States, you are responsible for complying with all local and/or international laws. You agree that we will monitor all activity on the Services and, at our sole discretion, terminate any User’s use of the Services.
LEGAL INFORMATION, DISCLAIMERS OF WARRANTIES, AND RELEASES FROM LIABILITY
Any reference to Community Medical Services includes our affiliates, subsidiaries, officers, directors, shareholders, employees, and agents. Any first-person pronouns mean Community Medical Services.
The Services are for informational purposes only. The Services do not substitute for professional healthcare advice, diagnosis, or treatment. We will not set up any healthcare relationship with a User or provide any healthcare services through the Services. If you are experiencing a medical or behavioral health emergency, call 911.
The Services are provided “as is” and use of the Services is at your own risk. We cannot guarantee that the Services will be uninterrupted, error-free, or free of viruses, worms, Trojan horses, harmful or malicious code, or any other defects or issues. We do not guarantee the accuracy, reliability, or current relevance of any information associated with the Services. We will not be liable for any damages of any kind arising out of, or related to, the use or inability to use the Services. To the fullest extent of the law, we disclaim all warranties and conditions, express or implied, with regard to the information, materials, and content of the Services including without limitation implied warranties of merchantability and fitness for a particular purpose. The content, design, underlying code, and all other aspects of the Services are the sole property of Community Medical Services and are protected by intellectual property laws, including U.S. copyright laws. Data mining, harvesting, and other forms of collection of information from the website for marketing or commercial purposes are prohibited. Users may view, print, and download publicly available information for personal and non-commercial use, but they are not allowed to republish, modify, or excerpt any part without our express written permission. We own all information submitted through the Services. Except as prohibited by law or this Policy, we may use, sell, exploit, and disclose such information in any manner without compensation or notification to the User.
LAW AND VENUE
You agree that the laws of the State of Arizona apply to this Policy and your use of the Services without regard to Arizona’s conflict of laws principles. User irrevocably and unconditionally consents to the exclusive jurisdiction of the Superior Court of the State of Arizona located in Maricopa County, Arizona.
